  Hey Daniel, I hope you having a great day.  Got 2 questions my friend. First, like you, I love the old Universal world, and I would love to do some "Abbott and Costella" paintings and prints.  How do you go about getting a License to do that?

 Second, what brand of oils do you use. When you send me my first tubes of paint you sent "Daler-Rowney"  Is this the brand you normally use?  I bought a couple of new colors of this brand, and will be using them on a painting I am doing of Suzi. 

   I feel like I have a good grasp of the Corel Painter Program now, (I only use in for publishing work, which now I am moving away from to do my own things) and I want to get back to training with the oils if you have time to look at what I am doing. There is much I want to talk with you about in a phone call.

Dear Nick,

It's a good idea to get the art licenced.

If the actors are no longer with us, maybe their children are the ones to ask.

I have the Chaney license and the karloff license.

I deal with Sara karloff, Boris's daughter and Ron Chaney, Lon's grandson.


I mostly use the UTRECHT brand oil paint.

Chris Costello, is Lou's daughter and she is the one to ask.

Daniel  ... Hello from a new member.

I have a question regarding this subject    ....It is my understanding that there are certain numbers of items that you can produce (small quanities) and not obtain a license ...yhat it is  then considered "Fan Art" or you call it a name other than what it really is.... as an example .... instead of "The Creature of The Black Lagoon"   you call it " Monster From The Deep".?  How many do you have to produce in order to worry about a License.   Are there any hard fast rules?.   What laws govern the copyrights. to say a face rather than a character.   Is there a difference?     

 

What about if you are making one of a kind products?

Dear Psyche,

That is a vbery good question.

For an example: I want to make a Christopher Lee Dracula life size bust.

I make tribute busts that are ONE OF A KIND even though they come from the same mold.

Since there is a high level if hand work on each piece, they are essentially one of a kind.

You may not manufacture images  that are copy righted with out the owners permission.

This is a gray area.

Is fan art different than tribute are or small editions?

Well the law says yes.

But what we do is artistic interpretations which is covered under the free speach.

You can not sell a photo that was taken by a photographer and make prints of it but you can use that photo as a basis for a painting.

To be safe , getting a licence is the best was , all clean and straight.

But if I want to paint a picture of Christopher Lee as Dracula, I have that right.


Another example: Sara Karloff OWNS the rights to Boris Karloff's likeness but UNIVERSAL owns the rights to the Frankenstein make up.

If you look at some of my life size busts, they look like the actors and characters but they are not a photographic reproduction of them.

I go for the FEEL of the character.

You must use your own judgement on thise things.

if you make prints of Disney's little mermaid, Disney will shit hammer you as faster than you can say  zippity do da!

Bit you can make a painting of her and have the right to sell it.

A good rule of thumb: Fan art generally refers to fan labor artworks by amateur artists, or artists who are unpaid for their fan creations.

Thank you Daniel. That is one of those things that you have to be careful of.  I will contact Chris. I think she runs a fan site for them. Hopefully it will be affordable.

Hey Daniel, and hey Psyche, it's nice to meet you. That brand of Paint UTRECHT I didn't see at hobby lobby, but I am sure I can find it online, but my question is.  Do you use it because the quality is superior? Or because it has a better range of colors? Is this the brand you told me about that cost alot, but last for years? I guess what I am really getting at is it worth it. Does it make a difference in the way your finished painting looks? Also, you taught me to put a coat or 3 of Liquid over the finished painting and it acts like a varnish? or do I still need to Varnish it.?

    Brother, I am back to painting in oils again, and I have never been happier. Digital art is a necessary evil, but painting in oils is an act of love.  Also I was looking at your mask, alot of them I can afford, so I am going to start ordering one a month starting oct 1st.  I hope you take Paypal.
